1.1 This page contains the legal terms and conditions that govern the site loja.patrimoniocultural.gov.pt. Browsing the website implies acceptance of all the provisions regulated by these general terms and conditions and other instructions for use contained in the website.
1.2 The Cultural Heritage, Public Institute, has products for sale on the website loja.patrimoniocultural.gov.pt, exclusively for end consumers.
1.3 Cultural Heritage, Public Institute, e-commerce services cannot be used for resale.
1.4 Cultural Heritage, Public Institute, reserves the right not to process orders received from users who do not meet the above requirements.
1.5 The consumer shall provide Cultural Heritage, Public Institute, with a valid e-mail address, or any other contact details, and agrees, if necessary, to be contacted using the details provided.
For the purposes of these general conditions, the following definitions shall apply:
“Site”: the domain www.patrimoniocultural.gov.pt and loja.patrimoniocultural.gov.pt, made available to internet users;
“Cultural Heritage, Public Institute” – Products sold through the website loja.patrimoniocultural.gov.pt.
“User” – Any sole trader who places an order through the website.
Access and use of loja.patrimoniocultural.gov.pt implies the User accepts, through this access or use, the terms and conditions of use, without prejudice to any clause on the website and www.patrimoniocultural.gov.pt.
If the User does not agree with the clauses and conditions of use of this Notice, the User must refrain from using the Site.
2. Ordering
The terms and conditions regulate the contract between Cultural Heritage, Public Institute, and the user, with regard to purchases of products made through this website. Any user can browse the site, but to access the sales service it will be necessary to have the requirements to enter into legally binding contracts, according to Portuguese and European Community Law. You must be in possession of a valid e-mail address and bank account details. For the customer to place an order, it is mandatory to fill in all the necessary data and accept the terms and conditions. Until the order is finalised, the customer may, at any time, change all the data relating to their order.
To make purchases at loja.patrimoniocultural.gov.pt, the user must have a valid e-mail account and create a customer account.
Place an order on loja.patrimoniocultural.gov.pt:
a. Find the products;
b. Add the products to the Cart;
c. Access your customer account or create a new one;
d. Review your order;
e. Finalise the purchase;
f. Select the payment option;
g. Proceed with payment and confirm the order;
h. You will receive an order confirmation e-mail;
By sending the order form you accept the general conditions of purchase, as well as other conditions existing in loja.patrimoniocultural.gov.pt.
We reserve the right not to accept your order or to cancel it even after automatic confirmation.
The Cultural Heritage, Public Institute, Store reserves the right not to process incomplete or incorrect orders or orders in which the products ordered are no longer available. You will be informed by e-mail, within a maximum period of 15 days, that the sales contract has not been carried out and that the Cultural Heritage, Public Institute, did not proceed with the sale, specifying the reasons.
If an order has been placed and the respective payment made for products that are no longer available, the Cultural Heritage, Public Institute, Store will return the amount paid for those products within 30 days.

3. Right not to accept the order or cancel the purchase
The Cultural Heritage, Public Institute, Store reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase, even if it has already been accepted, in the following situations, exempt from liability for any damages or costs:
a. The product is no longer available in stock (payments will be returned within 30 days);
b. The billing information is not correct or verifiable;
c. The order is flagged as an incorrect order or an order susceptible to fraud;
d. The transfer for payment of the order has not been received by us within 5 days after acceptance of your order;
e. If there are indications that the purchaser is under 16 years of age;
f. If there are indications that the purchaser is a reseller;
g. It is not possible to deliver to the address provided.
4. Payment Methods
You can find the available payment methods in the Delivery and Payment section of the online shop. We do not accept any other method of payment besides those mentioned. We cannot be held liable for loss of payment or any other damages for payments made by means not provided for on our site.
5. Price
The prices of the products in the online shop – loja.patrimoniocultural.gov.pt– are all quoted in euros and include Value Added Tax (VAT) at the legal rate in force in the country of origin (Portugal). Shipping rates are applied per order and depend on the country where your order will be delivered and its total weight. The total price specified in the final checkout menu includes taxes and shipping costs.

6. Price changes
Cultural Heritage, Public Institute, reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
7. Payment and security
Purchases made on loja.patrimoniocultural.gov.pt are secure. All purchases, once made, have a payment deadline that depends on the selected payment method. If you exceed the payment limit, the validity of the purchase is not guaranteed.
8. Delivery
The Cultural Heritage, Public Institute, Store will send the orders from Monday to Friday, except public holidays, to the address indicated by the user when confirming the order. Cultural Heritage, Public Institute, undertakes to send the order between the 2nd day after payment and a maximum period of 7 days from the day payment is validated.
9. Conditions of Ownership
The Cultural Heritage, Public Institute, Shop owns the products until it has received full payment for them.
10. Quality and Warranty

Should you decide to exercise the right to return a product, the Cultural Heritage, Public Institute, Store has the right not to accept products that are returned without packaging, damaged or altered from their original condition.
11. Promotional Codes (discounts)
Promotional codes can only be used on online purchases made on the site, and may not be sold, exchanged or donated.
The use of promotional codes for commercial purposes is not permitted. Promotional codes are not exchangeable for cash and cannot be combined with any other promotions.

12. Availability
Fulfilment of all orders placed on the site is subject to availability. The Cultural Heritage, Public Institute, Shop tries to ensure that all items offered for sale on the website are in stock. However, the Store reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer in stock. In these cases, the Store will inform the user/customer and proceed to refund the amount paid.
13. Responsibility
The Cultural Heritage, Public Institute, Store shall only be liable for damages suffered by the Customer in the event that such damages result from breaches attributable to the Store’s contractual obligations or in the event that the Store’s liability results from applicable legal law.
The Cultural Heritage, Public Institute, Store may not be held liable for damages suffered by third parties as a result of the improper use of the products.
14. Applicable laws
These general conditions and all disputes arising in connection with these general conditions, including their validity, the use of the site or any purchase on the site shall be governed by Portuguese law.
15. Amendment of Terms and Conditions
The Cultural Heritage, Public Institute, shop has the right to amend these Terms and Conditions at any time. The user is subject to the principles and terms in force at the date of his/her order unless any change to them is imposed by law or competent authority.
The Cultural Heritage, Public Institute, reserves the right to change these Terms and Conditions at any time, after notification, which shall be made by publication on the website loja.patrimoniocultural.gov.pt. Cultural Heritage, Public Institute, reserves the right to modify the contents of the website (prices, descriptions and photos) at any time, without prior notice and at its own discretion.
